Terms of Use

1. Acceptance

These Terms of Use ("Terms") govern your access to and use of the GeloPal website, software, and services (the "Service"), operated by GeloPal("we", "us", "our"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old (or the legal age of majority in your jurisdiction) to use the Service. By creating an account you represent and warrant that you meet this requirement and that the information you provide is accurate and current.

3. Your account

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at the Contact page if you believe your account has been compromised. You may close your account at any time through the billing page; we will treat the closure under the data-retention rules in our Privacy Policy.

4. Plans, billing, and refunds

The Service is offered on a free tier and several paid plans (subscription, lifetime deal, and one-time add-ons). Subscription pricing and quotas are shown on the pricing page and at checkout.

Subscriptions renew automatically until you cancel. Cancelling stops all future charges and downgrades you to the free tier at the end of your current billing cycle (or immediately if you elect immediate cancellation).

We process payments through Stripe. By providing payment information you authorize us and Stripe to charge the amounts displayed at checkout to your selected payment method. We do not store full card numbers on our servers.

Refund requests are evaluated case by case and may be issued at our discretion. To request a refund, message us on the relevant invoice via your billing page or contact us.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or to violate any applicable law.
  • Resell, sublicense, or redistribute the Service without our written permission.
  • Reverse-engineer, decompile, or attempt to extract the Service's source code, except as permitted by law.
  • Probe, scan, or test the vulnerability of any system without authorization, or breach security or authentication measures.
  • Upload malware, spam, or content that infringes the rights of others.
  • Use automated means (scraping, bots) to access the Service in a manner that places undue load on our infrastructure.
  • Misuse AI features to generate disallowed content or impersonate third parties.

6. Your content

You retain ownership of the recipes, ingredient prices, business configuration, and other materials you create or upload ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Your Content solely as needed to provide the Service. We do not use Your Content to train AI models. You can export and download Your Content via the Recovery Add-on.

7. Our intellectual property

The Service, including the GeloPal name, brand, recipe engine, ingredient database compilations, AI prompts, code, copy, and visual design, is owned by GeloPal and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business or personal purposes, subject to these Terms.

8. AI outputs & informational use

AI-generated suggestions (recipe analysis, pricing strategy, flavor pairings, etc.) and calculator outputs are informational and provided "as-is". They are not professional food-science, regulatory, financial, or legal advice. You are responsible for verifying and validating any output before using it commercially. Compliance with food-safety regulations (FDA 21 CFR, Codex, EU directives, local health departments) remains your responsibility.

9. Service availability

We aim for high availability but do not guarantee the Service will be uninterrupted, error-free, or always meet your requirements. We may modify, suspend, or discontinue features with reasonable notice. Scheduled maintenance and emergency security interventions may occur without notice when necessary.

10. Termination

We may suspend or terminate your account if you violate these Terms or use the Service in a way that risks harm to us, other users, or third parties. On termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination (intellectual property, disclaimers, limitations of liability) will survive.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GELOPAL AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD 100.

13. Indemnification

You agree to indemnify and hold GeloPal harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms.

14. Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which GeloPal is established, without regard to conflict-of-law principles. Disputes will be resolved in the competent courts of that jurisdiction unless mandatory consumer-protection laws of your residence specify otherwise.

15. Changes to these Terms

We may revise these Terms from time to time. Material changes will be announced in-app or via email. Continued use of the Service after the effective date of a revision means you accept the revised Terms.
